Mr. Falk’s practice since 1988 has concentrated in the defense of manufacturers, suppliers, and contractors in toxic tort litigation. He has practiced in such diverse areas as asbestos, silica, solvents, aromatic and chlorinated hydrocarbons, etc. His clients have included such Fortune 500 corporations as Honeywell, f/k/a Allied Signal, General Motors, DaimlerChrysler, Ford Motor Company, Mine Safety and Appliances Company, Illinois Tool Works, and a variety of regional contractors and suppliers. He regularly handles matters and trials for his clients in the courts of the Commonwealth of Pennsylvania, the State of West Virginia, and, on a pro hac vice basis, in a variety of other jurisdictions including, Texas, New York, Ohio, California, Mississippi, Washington, Georgia, Florida, and Delaware. He has gained expertise in a variety of industrial hygiene, epidemiology, pathology, and “state of the art” matters insofar as they impact toxic torts and currently is used by many of his clients to assist their local attorneys in both the pre-trial preparation and trial of issues pertaining to these areas, often acting as co-lead counsel with the local attorney at trial. In that regard, Mr. Falk has been designated by his clients to act as their lead attorney handling both pre-trial discovery and then cross examination at trial of certain Plaintiff experts within these areas. He has handled, both for trial purposes and administratively, literally thousands of such cases, including the “Mass Liability” trials in West Virginia, where up to 11,000 cases were litigated in one trial setting.

Prior to joining Davies, McFarland & Carroll, P.C. as a shareholder in 1997, Mr. Falk practiced in asbestos and toxic tort litigation at the Pittsburgh, Pennsylvania firms of Meyer, Darragh, Buckler, Bebenek & Eck, from 1988 - 1992, and Pietragallo, Bosick & Gordon, from 1992 - 1996. He is active in the Defense Research Institute (DRI), the American Bar Association (ABA), and was the chair of DRI’s Industrywide Litigation Committee and the newsletter editor for the Toxic Tort and Environmental Law Committee. He is currently a vice chair of the ABA’s Toxic Tort Committee. Mr. Falk has also been a speaker at the DRI Asbestos Medicine Seminar and is the author of Dartez v. Fibreboard; Evidentiary Implications for State of the Art Industrywide Litigation, which appeared in Mealey’s Litigation Reports -- Asbestos (Volume 11, #6, April 19, 1996). He is also a co-author of "Developing Strategy in Mass Tort Litigation," which appeared in the September 2003 issue of
For the Defense, the publication of the Defense Research Institute.

The Toxic Tort Department of Davies, McFarland & Carroll, P.C., where Mr. Falk practices, has extensive experience in defending its clients against asbestos and toxic exposure claims. The firm acts as either national coordinating counsel or national trial counsel for several of its clients and is committed to the efficient management of toxic tort litigation. It has created computer databases, each designed to the unique circumstances of each client, that accurately track thousands of claims for each client and works closely with each client to effectively manage, search, and control literally hundreds of thousands of documents.
